Paul Kim practices civil litigation throughout California state and federal courts, with an emphasis on construction law matters. Paul represents public entities, private owners, developers, general contractors, subcontractors, design professionals, and sureties on a wide range of issues within the construction industry, including, complex litigation matters.

Paul was previously with Varela, Lee, Metz & Guarino, LLP, where he represented construction industry clients across the United States in disputes arising from multi-million to billion dollar private and government construction contracts.

Paul received his B.A., cum laude, in Behavioral Science from California State Polytechnic University, Pomona. He was awarded his J.D. from University of California, Hastings College of the Law, where he was awarded the CALI Award for Trial Advocacy and was an articles editor for the Hastings Business Law Journal.

  • Defended and prosecuted construction defect claims on behalf of real estate developers, prime contractors, subcontractors, and commercial liability insurers.
  • Obtained summary judgment relief on behalf of intervening insurer and insured prime contractor against a real estate developer on a mixed-use condominium project.
  • Routinely handled lawsuits designated complex involving numerous plaintiffs, defendants, cross-complainants, and cross-defendants.
  • Achieved a $5,000 settlement on a $100,000 prevailing wage claim asserted against a prime contractor by purported employees arising on a public works project.
  • Second-chaired 12-day-long bench trial defending a surety on a performance bond claim asserted by the prime contractor following the default of the bond’s principal, an excavation/grading subcontractor, on a Caltrans bridge replacement project.
  • Second-chaired a 10-day-long arbitration concerning a profit sharing provision arising from a construction management teaming agreement on a county hospital renovation project.
  • Conducted extensive electronic document review, fact investigation, and deposition preparation in defense of a $40 million claim arising from a $1.3 billion Army Corps of Engineers design-build contract.
  • Propounded and responded to discovery demands in support of an indemnity and breach of contract claim on behalf of a prime contractor against a subcontractor who installed defective concrete at a hospital project.
