Mandatory Labor Department Posting For Employers With Under 500 Employees

Those receiving Murphy Austin’s daily COVID-19 Employer Updates know that last week, Congress passed the Families First Coronavirus Response Act (“FFCRA”), which creates new paid sick leave and expanded family and medical leave obligations for employers with less than 500 employees.

The law also requires covered employers to post a notice about the FFCRA in a conspicuous place on its premises. For employees working remotely, an employer can satisfy this posting requirement by emailing or direct mailing the notice to employees, or posting the notice on an employee information internal or external website.

This notice only needs to be given to current employees and new hires. The notice does not need to be given to former employees (including the recently laid off) nor to job applicants. Again, all employers with less than 500 employees need to post this notice.
